            In pursuance of S.D.O.(S), Dibrugarh’s letter vide No.DLL.6/2009 dt. 17.12 09 the following Information Handbook is prepared in respect of Excise branch of the office of the Deputy Commissioner, Dibrugarh for information and necessary action.

(i) The particulars of functions and duties of the District Excise officials:

(ii) The Powers and Duties of Officers & Employees :

            a) Deputy Commissioner, Dibrugarh: The D.C. Dibrugarh is primarily responsible for the Excise Administration of the district and the control of the district Excise staff. He issues licences of IMFL/BEER (off)/ (on) shops with the previous sanction of the State Govt. He makes settlement of Country Spirit shops in consultation with an Advisory Committee.

            b) Superintendent of Excise, Dibrugarh: He is the Chief Executive Excise officer in the district. He is directly responsible for every branch of the Excise administration but works in subordination to the D.C. Dibrugarh, as regards whom he occupies the position of a technical adviser. Subject to the control of the D.C, Dibrugarh he is empowered to issue orders on Excise matters. He is in immediate charge of the sadar Excise office and functions as the head of that office. He is to take part in detection as an example and stimulus to his subordinates. He is primarily responsible for collection of Excise revenue in the district. He also acts as DDO in respect of the officers and employees of the district. He, in subordination to the D.C. Dibrugarh and subject to the general control of the Excise Commissioner, Assam throughout the district exercises all powers and perform all duties conferred on the District collector by the Assam Excise Act, 1910 as envisaged vide Govt. order No. MEX 60/45/1 dated 11th April, 1945. He is also the appointing, transferring and punishing authority of Excise constables of Dibrugarh dist.

            c) Deputy Supdt. of Excise, Dibrugarh: Subject to the general supervision of the D.C. Dibrugarh and the general control of the Commissioner of Excise, Assam, the D.S.E Dibrugarh in subordination to the Supdt. of Excise, Dibrugarh exercises all powers and perform all duties conferred on the Supdt. of Excise by the Assam Excise Act,1910 vide Govt. order No. MEX.60/45/1 dated 11th April, 1945. He is primarily responsible for revenue collection and detection of cases in his jurisdiction.

            d) Inspector of Excise: Inspectors of Excise, Dibrugarh (S), Dibrugarh (Rly), Moran, Lahowal, Chabua, Tengakhat, Naharkatia, Tingkhong and the Officer-in charges of Bonded Warehouses of Dibrugarh district are directly subordinate to the DSE, Dibrugarh and to the Supdt. of Excise, Dibrugarh and under the general control of the D.C. Dibrugarh. They should inspect all licensed premises in their respective jurisdiction. They are directly responsible for detection of Excise and NDPS cases. They exercise all powers and perform all duties conferred and imposed on Excise officers as specified vide Govt. order No. MEX 60/45/1 dated 11th April, 1945.

            e) Assistant Inspectors of Excise: The AIEs under the general control of the Commissioner of Excise, Assam and in subordination to the D.C. Dibrugarh are directly subordinate to the Supdt. of Excise, Dibrugarh, DSE, Dibrugarhand the Inspector of Excise concerned. He is responsible for efficient working of the staff serving under him. He assists the Inspectors of Excise in all matters and obeys all the instructions given to him from time to time. He exercises all powers and perform duties as provided vide Govt. order No. MEX 60/45/1 dated 11th April, 1945.

            f) Excise Head Constables: Subject to general control of the D.C. Dibrugarh and in subordination to the S.E. Dibrugarh, DSEs, IEs and AIEs concerned they performs duties as provided vide Govt. order No. MEX 60/45/1 dated 11th April, 1945.

            g) Excise Constables: Subject to general control of the D.C. Dibrugarh and in subordination to the S.E. Dibrugarh, DSEs, IEs , AIEs and the HECs concerned they performs duties as provided vide Govt. order No. MEX 60/45/1 dated 11th April, 1945.

 

iii) The procedure followed in the decision-making process, including channels of supervision and accountability:

a) General Administrative Matters:  The papers are marked to the concerned dealing Asstt. by the Supdt. of Excise, Dibrugarh and the DA put up the papers in concerned file. Then a decision is taken on the matter by the Supdt. of Excise, Dibrugarh. If the matter ought to be put up to the D.C. Dibrugarh, then the file is put up to D.C. with comments and suggestions of the Supdt. of Excise and a final decision is taken by the D.C. Dibrugarh.

b) Licensing of IMFL shops:  On receipt of any application for grant of IMFL licences, the enclosed documents and papers are first scrutinized by the S.E. Dibrugarh. If found OK then the proposal is sent for enquiry to the concerned Inspector of Excise. The IE submits report alongwith his comments as per proforma to the SE and then the proposal is scrutinized by the concerned DSE. If found to be in order in all aspects then the proposal is put up to D.C. and a final decision on forwarding of the same to the Commissioner of Excise, Assam is taken by the D.C.

c) Enforcement Activities: The Inspector of Excise of the concerned circle is responsible for detection of Excise cases. Cases are detected on specific information or on sudden raids. The SE and the DSEs also supervise sudden excise raids.

iv) Norms set for discharge of its functions:

The target for collection of Revenue for the year 2009-10 has been set at Rs.18.82 crores.

Collection of Revenue till January, 2010 is Rs.13.33 crores.

Objections from local bodies like Municipalities, Town Committees, Gaon Panchayats, Neighbours are to be ascertained for granting of liquor licences. Rule 183(2) and 191 of A.E. Rules, 1945.

The country spirit shops are settled by the D.C. Dibrugarh in consultation with an Advisory Committee of not more than five members including representatives of SC, ST, OBC.

a) Advisory committee for settlement of Country Spirit shops: It consists of maximum 5 members including representatives of SC, ST, OBC.

b) Mohkuma Prohibition Committee: It consists of non-official members with conviction for the cause of prohibition. Supdt. of Excise, Dibrugarh is the ex-officio Secretary of this committee.
